Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of drowning: (a)At the establishment on the treatment lagoons: Employees were required to work on/from a pontoon boat, manufactured by the employer, which was not designed with adequate stability to handle all anticipated loads or tasks, on or about January 28, 1995 One feasible and useful abatement method would be to purchase and use a boat properly designed to do the tasks the employer was accomplishing with the pontoon boat. Another method would be to tow the floating pump assembly to shore with a stable boat before repair work is performed.ing
