Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of being struck by suspended loads when the Hitachi UH181 Hydraulic Excavator serial #163-0602 was used with a 15kw Ohio Generator and a 58" Load Star Magnet to lift misc. metals while employee was reading part number on metal ring while the load was suspended on or about 11/18/98 Among other methods, one feasible and acceptable method to correct hazard is to: 1) diligently enforce the company policy prohibiting employees from working under or near suspended loads and to enforce the company disciplinary policy that was in place before this accident. 2) install a secondary pulley system so that in case of main source failure, the secondary source would allow the magnet to complete the task safely.
