Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Hazard of being struck by nails intentionally discharged from pneumatically driven nailer as a result of employees engaging in horse-play, at Jackson Academy on or about August 8, 1995. A Paslode Mod. #3250-F16 nailer was used to discharge nails at employees by manually retracting the work-contacting element (nose piece). One employee received nail penetration in his foot. One feasible and acceptable abatement method, among other methods, to correct this hazard is make certain that the work contacting element is in contact with workpiece and not overridden manually.
