Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: falling onto electrical metallic tubing. (a)Center Hallway of Main Building at proposed Nurses' Station - Employees were exposed to falling onto one-half inch diameter electrical metallic tubing (EMT) embedded into subsurface and protruding through, and 12 inches above, the concrete floor slab to serve as anchors at five (5) locations for PVC conduit for electrical/communications conductors. Among other methods, one feasible and acceptable abatement method to correct this hazard is to shorten the conduit/anchor(s) and cover with suitable guard(s).
