Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were permitted to use material lift as personnel lift, exposing them to fall of 12 feet: a) Closic's World of Baby Furniture, Warehouse - Employees using genie powered super lift Model PSL18, Serial Number 1883-471 as personnel lift is violation of manufacturer's safety rules; 4-11-90. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to eliminate the use of material lift as personnel lift.
