Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown out of the operator's seat and being crushed by an industrial lift truck : a)In the workplace, Simplex Nails, Inc. - Employees operating a Hyster (Serial Number C187V14583S Model S50XL) were not using the seat belt, on or about 02/27/97. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce the use of seat belts on all equipment having seat belts installed. 1. Ensure that employees utilize seat belts while operating industrial trucks.ial
