Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling car/van. Tony's Service Inc. 43 Lake Street White Plains NY 10603 On or before 4/10/95, The employer did not follow the Operation and Service Instruction Manual supplied with the BENWIL GP-7 automotive lift in that: a) The employer did not make sure all employees using the lift read the manual. b) When lifting vans and light trucks optional truck adapters which adapt to the lifting points of these vehicles were not used. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD IS: 1) To use optional truck adapters when lifting vans or light trucks and ensuring that all employees using the BENWIL GP-7 Automotive lift read and understand the Operation & Service Instructions manual before attempting to operate the lift 2) Follow section 6.2.2 of ANSI B153.1-1981 (Safety requirements for the construction, care, and use of automotive lifts) which states "The owner or employer shall ensure that operators of automotive lifts are instructed in the safe use and operation of the lift".
