Section 5(a)(1) of the Occupatonal Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Falk Industries Inc.: The employees were riding in the freight elevator. The elevator was not equipped with safety gates in the front and rear. As required by ANSI/ASME A 17.3-1986 Safety Code For Existing Elevator and Escalators, and BOCA1984 Sec. 2105 9.5. Safety Gates on Elevator Cars. Employees that were riding in the freight elevator were exposed to a hazard of being crushed between the elevator floor and the door casing on the Basement, First and Second Floors. Feasible and acceptable methods among others to correct this hazard is to: (1)Comply with ANSI/ASME A17.3 - 1986 and BOCA 1984 standards. (2)Enforce the company policy that restricts the use of the freight elevator to freight only no passengers allowed. (3)Conduct periodic inspections of the elevator as required by the ANSI/ASME and BOCA Standards. To insure integrity of the interlocks, ropes, switches for gates and equipment and document above. (4)Fully enclose the freight elevator car as required by the standard. If used for freight only then install beveled guards on all the inside ledges of the hoistway enclosures i.e. Basement, first and second floor. NOTE: Beveled guards are for freight elevator only, not for passenger protection. A search of the OSHA Standards has been conducted and there are no applicable standards.
