Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck by falling pieces of material that are not secured to the forks of the Lull Falcon 600 Rough Terrain Forklift, Serial# G2S12K11-117, while being transported. Construction Site: 6 Gramatan Avenue, Mount Vernon, NY 10550 - First Floor on or about 8/19/95 a) Employee exposed to the hazards of being struck by steel beams that were not secured to the forks of a Lull Falcon 600, Serial# G2S12K11-117 Rough Terrain Forklift, while they were being transported from the front of the building to the rear of the building. "Among other methods, one feasible and acceptable abatement method to correct this hazard is..." 1. Follow the Equipment Manufacturers Institute (EMI) recommendations for safe operating procedures contained in their manual, "Rough Terrain Forklift, Safety manual for Operators and Mechanics", on pages 21, 22, and 24. 2. Prohibit employees from operating material handling machines without the loads being secured to prevent them from displacing or falling. 3. Train employees in the hazards associated with using a rough terrain forklift, and securing loads.
