Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a falling automotive lift while working underneath. a) Establishment: Single post automotive lift on the south side and east end of the work bays was equipped with a safety device which was non-functional in that it was corroded and did not fall into place when the lift was elevated to its full extension, as observed on or about 09/01/95. b) Establishment: Double post automotive lift on the south side and west end of the work bays was equipped with two safety devices, one of which was non-functional in that it was corroded and did not fall into place when the left was elevated to its full extension, as observed on or about 09/01/95.
