Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about December 9, 1991, employee was working under "Hyster Lift Truck", SN A187404219G at the Flores Paper Recycling Inc. Plant at 9016 NW 105 Way, Medley, FL 33178; exposing employee to crushing injury i.e. the center of gravity was shifted when jacks were placed under the Hyster Lift Truck and blocking was not provided under the counterweight. Among other methods one feasible and acceptable method to correct this is strict enforcement policy prohibiting the lifting and/or blocking of equipment that is not designed or recommended by the manufacturer: (Hyster Lift Trucks).
