OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) On or about 08/25/15, in the facility at 44-28 55th Ave, Maspeth. NY An employee was standing on an elevated platform (pallet) attached to the forks of a powered industrial truck retrieving inventory from the 2nd level of a 4 level metal storage rack and fell approximately 10 ft. to the concrete floor.
