Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by steel shelving unit and/or its contents: a)On 11/21/97 and 11/22/97 - Job site, 34-17 College Point Blvd. Employees worked and walked in the area in which a steel shelving unit, 104'L x 3'W x 14'H, was erected. The asphalt and concrete surface on which the shelving was erected was inadequate in strength to support the shelving. The concrete was not tested to determine the compressive strength of the area prior to installation. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO: 1)Prior to installation, ascertain that the surface has adequate compressive strength to support the maximum intended load. Reference the American National Standard MH16.2-1984, Manual of Safety Practices-A Code of Safety Practices for the Use of Industrial and Commercial Steel Storage Racks, Section 1.4, Base Plates and Anchoring; Section 1.5g Moving Forces and Overturning; and Section 2.5, To Anchor or Not to Anchor. WRITTEN ABATEMENT VERIFICATION IS NOT REQUIRED.
