Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from an elevation while working from suspended scaffold: a) Cupola Rebricking Operations - 4 pt. suspended brick lining scaffold was not being moved or relocated under the supervision of a competent, qualified person who has knowledge and/or experience in making such moves. Among other methods, one feasible and acceptable abatement method to correct the hazard is: 1. The employer shall instruct each employee required to work from suspended scaffolds in the recognition and avoidance of unsafe conditions and regulations applicable to suspended scaffolds to control or eliminate any hazard or other exposure to illness or injury. 2. The employer shall train persons responsibile for erecting moving, dismantling or altering suspended scaffolds through manufacturer's drawings or instruction manuals and practical experience to insure that they are capable of identifying existing or predictable hazards of suspended scaffolds and related safety equipment which are hazardous to employees.
