OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that rail cars were being supported with homemade supports that were not rated for capacity or load tested: A.) Warren Railcar Service Inc. - On or about 8/19/15, and at times prior thereto, the company was utilizing metal support that had been made in house to support rail cars. Employees work under, around, inside, and on top of the rail cars. The supports had not been load tested, rated for capacity or inspected. The metal supports had not been proof tested nor did they have any rated capacity markings or other identifying markings.
