Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using a step ladder to access and egress an elevated conveyor. In the Milnor dryer area, employees used a Keller fiberglass step ladder to gain access to the Pellerin Milnor conveyor at the #11 Milnor dryer location to perform maintenance work on the dryer. The employee climbed over the conveyor side shield that was approximately 27-inches high and was exposed to a fall hazard of over 8-feet to the concrete floor below.
