OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees, other than the operator, were permitted to ride the Wirtgen W120 Fi milling machine when seating, seat belts, or other protection equivalent to that provided for the operator, were not provided: (a) Route 50: On or about August 13, 2015, and times prior, employees, other than the operator, were permitted to ride the Wirtgen W 120 Fi milling machine, while in operation, exposing employees to crushing injuries.
