29 CFR 1926.202: Barricades for protection of employees did not conform to Part VI of the Manual on Uniform Traffic Control Devices (1988 Edition, Revision 3, or the Millennium Edition), incorporated by reference in Sec. 1926.6: a) Intermountain Slurry Seal, Inc. at Mile Marker 141 US Hwy 71, Last Chance, CO 80757: On or before July 23rd, 2015, the employer failed to provide a barricade or a shadow vehicle for the protection of an employee who was working in the traveled way of US Hwy 71 placing retro reflective tabs in the median, and operating a modified golf cart. This condition exposed the employee to a hazard of being struck by motor vehicles. Abatement note: The MUTCD, Millennium Edition, Figure 6H-17 (TA-17) provides a typical application depicting the use of a shadow vehicle as a barricade for mobile operations on a 2 lane road. In addition, section 6F-76 provides that a shadow vehicle shall be positioned at a safe distance in advance of workers or equipment being protected so that there will be sufficient distance, not so much so that errant vehicles will travel around the shadow truck and strike the protected workers and/or equipment. Another feasible and acceptable abatement method would be to close the lane being worked on through channeling devices and barricades as referenced in Figure 6H-10.
