Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Reference: American National Standards A.N.S.I. B30.11-1973 for Monorail Systems and Underhung Cranes. a) ¿ANSI B30.11-1973, section 11-1.3.4...All welding shall conform to the recommended practices of the American Welding Society as outlined in AWS D14.1 for industrial and mill cranes.! The cranes located in the welding department were welded by welders who were not certified welders and qualified under AWS D14.1 to perform welding operations on cranes. This is necessary in order to assure the integrity of the welds to prevent the failure of the crane system while lifting a load. b) ¿ANSI B30.11-1973, section 11-1.3.5..Monorail systems may be re-railed provided such modifications are approved by an qualified engineer or by the equipment manufacturer!. The following modifications were made to the cranes located in the welding department without the approval of a qualified engineer: 1. The horizonal I beam was lengthened to increase the horizontal reach of the crane. 2. The vertical section of the crane was raised approximately thirty-six inches to increase the vertical height. 3 I beam's of both cranes show visible signs of twisting, which is a sign of possible overloading. 4. I beam's were not leveled after installation. 5. Hoist mounted on the cranes exceeds the current markings on the crane. (1 ton hoist on a crane which was marked 1/2 ton prior to modifications.) 6. Adding an unboxed section of I beam between the top of the crane and its horizonal I beam. 7. Lifting spreader bars which were shop built were not load tested to assure that they can properly lift the modular wall panels with a standard safety factor. The above noted defects expose employees to the hazards of being struck by falling material as a result of the failure of the crane during an lifting operation.
