Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught in an unprotected elevator shaft. a)In the workplace, Kitchen Areas, on or about 12-05-2000: Employees working in the kitchen area of the restaurant were exposed to the hazards of an open hoistway (dumbwaiter) shaft where the hoistway doors were located on the first floor landing and the basement landing. Among other methods, a feasible and acceptable method of abatement to correct the hazard is to follow the requirements of the ASME Standard A17.1-1993 Safety Code for Elevators and Escalators, Part 700.11, Hoistways, including but not limited to the installation of interlock doors to prevent the movement of the hoistway while a doorway is open. Abatement documentation is required for this item.
