OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, as employees were exposed to the hazard of being crushed by a riding lawn mower that was operated on terrain with steep slopes: a) 5468 Route 9W, Newburgh, NY 12550 - On or about July 7, 2015, an employee was working on the lawn cutting the grass in a steep section of the cemetery with a Toro Groundsmaster 328-D 4-Wheel Drive model with a front deck mowing arrangement mowing a steep grade of 25 degrees or greater when the mower tipped and rolled over and pinned the employee beneath the rollover protection bar crushing the employee. The employee was not wearing a seat belt.
