OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards At OC3 on June 26, 2015, and times prior to; employees were exposed to crushing hazards resulting from crane failure and/or collapse, when the employer used a modified manufactured mobile truck crane, National Crane 600E2, serial number 299146. The original crane boom and base frame was designed for a truck's frame and outriggers; it was then secured to a structural steel frame and foundation without the manufacturer or a qualified person re-rating the crane and its load chart. Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: 1. Conduct load test in accordance with Manufacturer's Operating Manual and recommendation. 2. Conduct load test by a Crane Certifying Agency to establish credible load chart rating. 3. Validate maximum load capacity by Crane Certifying agency for crane with modified structure.
