Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential fall or crushing hazard: a)Port of Richmond. On or about 12-5-94, an employee was hoisted in the bucket of a front end loader (Terex, Model 70-C, ID #72825) approximately ten feet above the ground to loosen a sling assembly from an erected wooden pole. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the operation from a ladder.
