Text For Citation: 01 Item/Group: 001 Hazard: CONFINED
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to confined space conditions while spraying a two part epoxy coating to the interior surfaces of a 150,000 gallon horton watersphere. A confined space entry permit program was not developed or implemented to ensure that entrants are fully protected from confined space hazards. A) THE EMPLOYER HAD NOT DEVELOPED OR IMPLEMENTED A CONFINED SPACE ENTRY PERMIT PROGRAM TO PROTECT EMPLOYEES PERFORMING SPRAY PAINTING INSIDE CONFINED SPACES AT THE NEW BRAINTREE PRISON PROJECT. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO ESTABLISH AND IMPLEMENT A WRITTEN CONFINED SPACE ENTRY PERMIT PROGRAM THAT ADDRESSES HAZARD CONTROL AND RECOGNITION, A PERMIT SYSTEM, EMPLOYEE INFORMATION, PREVENTION OF UNAUTHORIZED ENTRY, PROPER EQUIPMENT MAINTENANCE AND USE, RESCUE PROCEDURES, PROTECTION FROM EXTERNAL HAZARDS, ATMOSPHERIC MONITORING AND TESTING, AND OUTSIDE CONTRACTOR POLICIES.
