OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck-by and/or caught-under large T bar beams: a) On or about June 26, 2015; panel assemble area: Employees were exposed to struck-by and/or caught-under hazards from large vertical T-beams being placed (tack welded) onto horizontal panels due to improper bracing of the T-beam. The employer has job safety analysis (JSA) procedures established and required to be filled out prior to jobs. The T-beam being positioned into place were the longest (34'), tallest (40"), and the heaviest (approximately 3000 pounds) they had worked with. The JSA filled out for the days activities did not include the issue of weight and proper bracing of the T-beams which were lowered onto the panel supports with a crane resting on the narrow edge and needed bracing to prevent it from tipping over while tack welding it.
