Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) A forklift truck was operated by an employee of Jones Oregon Stevedoring at Terminal 4 inside a railcar whose door was 3 feet 6 inches from the ground and no means was provided to ensure that the forklift could not be driven onto the platform positioned flush outside the railcar and then off the platform. A feasible and useful method of abatement for correcting this hazard among others is to raise the platform so the lift cannot be driven out onto it.
