Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to further injury due to improper restricted or light duty assignment: (a) Establishment - On or about August 2, 1991 an employee who had received a medical restriction of no use of left arm was assigned to operate the Mooradian chop saw cutting lumber, exposing the employee to aggravat- ing an existing injury and potential kickback to the material. Among other methods, one feasible and acceptable abatement method to correct this hazard is: Assign restricted work based on the medical limitations imposed by the physician.
