Section 5(a)1 of Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from not being restrained in a forklift in case of tipping and/or rollover: a)Bldg. 22124, Southwest Region Fleet Transportation of Camp Pendleton: A forklift operator did not wear his seatbelt while operating the Hyster 40 S.N. D177G38490U forklift on a cat walk approximately 3 feet from the ground which could have resulted in serious injuries as a result of a tipping and/or rollover accident. The employee who was a forklift mechanic, was testing the forklift after conducting repairs. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the operator manual under use of seatbelt: Always wear seatbelt while operating the machine to reduce the risk of personal injuries.
