Section 5(a)(1) of the Occupational Safety and Health Act of 1970: %% The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hoist failure: (a) Service Department: The manually operated chain hoist was not maintained in accordance with American National Standards Institute Safety Code for Overhead Hoists (Underhung)(ANSI B30.16-1987) NOTE: See appropriate note below: 1. The hoist trolley was damaged in that the trolley wheel guide was bent and the hoist had not been removed from service. See section 16-2.3.3(d). Among other methods, one feasible and acceptable abatement method to correct this hazards is: 1. Contract with a qualified person to repair the hoist trolley. 2. Train an employee or employees to conduct frequent inspections of the hoists.
