Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck by a lodged tree while cutting the second and third tree that supported the lodged tree, on the Robinson Ranch Timber Sale near Hawk Creek Road S.W. of Musselshell, Mt. on or about 3-12-92. Feasible and acceptable abatement methods, among others, to correct these hazards is to assure: 1. Lodged trees are taken down with a cable and skidder or other appropriate equipment. The sawyers shall not work out of site or hearing distance of other employees that can help in case of an emergency. The under cut wedge is cut deep enough to safely guide the tree to the ground. That enough holding wood is left to establish the direction of a falling tree and prevent premature slipping and twisting from the stump.
