OSH ACT of 1970 Section (5)(a)(1): Public Law 91-596, the Occupational Safety and Health Act of 1970, Section 5(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that an employee was exposed to a crush hazard by not wearing the installed seat belt while operating a forklift. a. Material Delivery Site - On or about June 18, 2015, the employer did not ensure that an employee utilized the installed seat belt while operating a Moffett Mounty forklift to unload a flatbed truck.
