Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of falling from heights, where an employee, on or about December 16, 1992, was lifted/lowered by equipment which was not designed for that purpose and was not provided any form of fall protection. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard would include immediately discontinuing the practice of raising/lowering personnel with the "Farmhand" until such time that a personnel platform designed for that purpose is made available.
