Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about September 22, 1992, and at times prior to, employees working at Jenner Equipment Company, Inc. in Rapid City, South Dakota, were exposed to the hazard of having body parts crushed due to contact with moving parts of tractor-mounted front-end loaders while the loaders were in a raised position. Safety devices known as "boom stops" manufactured by the employer were not designed in such a manner as to provide positive means of protection for employees who routinely work on tractor-mounted front-end loaders in the raised position. Among other methods, feasible and acceptable methods of abatement to correct the hazard would include to re-design the channel iron "boom stops" now in use, keeping in mind that all hydraulic cylinders on front-end loaders are not of the same configuration and provide "boom stops" with a positive means of being locked in place to ensure that they do not become dislodged while the front-end loader is in a raised position.
