Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to possible crushing injuries due to uncertified ROPS repair: a) Evans Sale, Dempsey Creek - on January 9, 1990 and at times prior thereto, the Rollover protection canopy on the case 1150B skidder was repaired by welding on the support beams without recertifying the canopy. Among other methods, one feasible and accepable abatement method to correct this hazard is: Have manufacturer recertify canopy or replace with unaltered canopy.
