Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught under a falling forklift due to the failure of the employer to ensure that the instructions of the forklift manufacturer were followed and that employees were trained in the procedures contained in those instructions: (a) In the shop - An employee was under a raised forklift that was not blocked in accordance with the instructions of the manufacturer of the forklift, on or about 1/3/95. (b) In the shop - An employee was under a raised forklift that was not blocked in accordance with the instructions of the manufacturer of the forklift, on or about 12/29/94. Among other methods, one feasible and acceptable method to correct this hazard is to support and block forklifts in accordance with the manufacturer's instructions and to train employees in the procedures contained therein.d
