Text For Citation: 01 Item/Group: 001 Hazard: FALLING

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falling from open tractor cab window on moving Case back hoe/loader number JG 17069. Church Avenue near East 9th Street. On or about September 28, 1994. Employee was riding on tractor moving at approximately twenty miles per hour. Rubber tired tractor was moving east on Church Avenue towards Coney Island Avenue. A feasible means of abatement would be: To prohibit passengers as noted in the Industrial and Construction Equipment Division of the Farm and Industrial Equipment Institute, publication SEB U6027 Form number BL10-3, "Safety Manual": Page 21, number 19; "Warning: Your Backhoe/Loader is a One Person Machine. Never Permit Riders. (19)" Or, as noted in the National Safety Council Publication; Data Sheet 256, Revision A, copyright 1971. "Motor Graders, Bulldozers, and Scrapers": Page 5, Paragraph 57; " No personnel except operators should be allowed to ride on equipment except for training purposes and then only when a seat is provided."
