Section 5(a)(1) of the Occupational Safety and Health Act of 1970: %% The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection from motor vehicle. The wearing of factory provided and installed seat belts was not enforced in the operation of the employer's delivery van. the wearing of seat belts at all times is required under New York State Motor Vehicle Laws: a) On or about May 20, 1993, an employee was operating a delivery van without the required wearing of seat belts. This omission exposed the employee to ejection from the vehicle to the roadway. ABATEMENT NOTE: Among others, a feasible method to eliminate or substantially reduce this hazard would be to comply with New York State Motor Vehicle Laws and enroll drivers in defensive driving
