Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about February 22, 1992 and at times prior thereto, at Crowley Maritime Corp., Petty's Island Terminal in Pennsauken, NJ, employees were exposed to possible serious injury in the workplace as a result of being struck by industrial equipment being operated by employees who were under the influence of controlled substances. Among other methods, one feasible and acceptable method to correct this hazard would be the following: 1) Assure proper implementation of the testing program for cause for those employees in safety sensitive positions and/or employees exhibiting patterns of behavior associated with controlled substance abuse.
