Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and falling hazards: The employer failed to have a passenger- carrying freight elevator inspected and maintained. a)In the workplace, southwest hall, between floors, on or about 08-13- 99: The employer failed to have the passenger-carrying freight elevator inspected in accordance with ANSI/ASME A17.3-1993 and New York State Labor Law 27-a subpart 8-1 Elevators in factories and mercantile establishments. Abatement certification must be submitted for this item. Among other methods, one feasible and acceptable abatement method to correct this hazard is to contract for an authorized agent to perform periodic inspections of the freight elevator in accordance with the applicable standards.
