Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling out of the bucket of a power shover when standing inside as the bucket is being raised or lowered; %% (a) Location: Pierson Lakes, Subdivision, Sloatsburg, NY; on or about 9/24/90 - Employee was riding in the bucket of an Insley Power Shovel, Model #H2500C and s/n H2639C. %% Among other methods of feasible and acceptable abatement method, among others, to correst this hazard is to prohibit employees to ride in the bucket of any power shovel at any time. %% %%
