Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls into an open elevator shaft or to being struck by the ascending/ descending car. a) Southwest side of the building, bi-parting doors and half- gate on Warsaw Freight Elevator can be opened when the elevator car is moving or not at the floor level. Employees are exposed to falls of over 14 feet or to being struck by the moving elevator car, on or about 12/9/92.
