Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling objects when unloading roll off trash containers: A)123 Varick Ave., Brooklyn, N.Y. - Employee(s) were exposed to being struck by falling objects from container R-9 during the dumping operation and/or the opening of the tailgate. On or about September 28, 1996. ABATEMENT NOTE: Among others, one feasible and acceptable method to eliminate or to materially reduce this hazard is to ensure employees are kept clear from the tail gate while it being opened and ensure employees are kept clear from the container during all phases of the dumping operation as referenced in ANSI Z245.1-1992, sections 6.2.1.(e) and 6.2.1(g).
