Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Worksite, 245 Park Ave, New York, N.Y. On or about 8/10/98 while working on two point suspended scaffolding at the 40th floor of the building employees were exposed to the hazard of being struck by falling bricks due to the collapse of sections of brick masonry weighing approximately 1600 pounds each. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1. Install and remove the temporary bracing of the brick piers in staged sequence so that at no time are the piers left without the required support; in conformance with industry and sound engineering practice.
