Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of vehicle collision while operating a tractor with faulty brakes: (a) Massey Ferguson 165 tractor used with a bush hog mower during mowing operations had an inoperable left brake. The operator was fatally injured when the tractor collided with a tree, on or about 5/7/92. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement a maintenance program according to manufacturers recommendations, and conduct inspections to monitor the proper operation of the tractors.
