Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling objects, such as tractor engine blocks and transmissions, in that: a) Seven (7) overhead, Jet Porter, Chicago Industrial, American Guage and B.B. Brothers, Inc. hoists had deficiencies; such as, rusty chains and no markings to inform employees of the hoist rating. Among other methods, on feasible and acceptable method to correct this hazard is to develop and implement an adequate inspection, testing and maintenance program and to mark each overhead hoist with the proper rating, manufacturer's identification and warnings in cautionary language, as per sections 16-1.1.1, 16-1.2.1, 16-1/2/2, and 16-1.2.3, ANSI B3016-1973 American National Standard, overhead hoists.
