Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of large trucks backing up to a loading station of a ready mix concrete plant and striking employees causing a crushing injury or death. Employees were routinely on foot in close proximity to backing trucks which did not have a clear view to the rear and did not have back-up alarms. Among other methods, one feasible and acceptable method to correct this hazard would be to install back-up alarms on the vehicles which had an obstructed view to the rear that would sound when the vehicle moved backwards. The vehicle should also have working back-up lights.
