P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown out of the operator's seat and being crushed by industrial lift truck: (a)GPA Warehouse Number 24 - The employee operating a HYSTER lift truck (Number 108, Serial Number G005D03019R, Model Number H110XL) was not using the seat belt, on or about 6/8/94. (b)GPA Warehouse Number 24 - The employee opeating a TOYOTA lift truck (Number 24) was not using the seatbelt, on or about 6/9/94. Among other methods, one feasible and acceptable abatement method to correct his hazard is to enforce the use of seatbelts on all equipment that has seatbelts installed to comply with a particular standard: 1.Ensure that employees utilize seatbelts while operating industrial trucks.
