Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being run over or struck by a moving skidder: a) 1980 Franklin Kkidder (Model 170 PSSB, Serial Number 10437), used with no braking system, exposed employees engaged in logging operations to the hazard(s) of being run over or struck by a skidder that cannot be stopped. Among other methods, one feasible and acceptable atatement method to correct this hazard is to comply with the manufacturer's requirement that this skidder have a braking system. This model utilized integral brakes as described in literature published by Franklin Equipment Co.
