Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being thrown out of a motor vehicle that is equipped with occupant safety belts because the occupant did not have the safety belt properly fastened. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the OSHA proposed standard 29 CFR 1936. 33(c)(1), which states: The employer shall require that each employee on official business, operation or occupying a motor vehicle equipped with safety belts or otherwise required by federal regulations to have belts, to have an occupant safety belt properly fastened at all times while the vehicle is in motion.
