Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Being thrown out of or against interior portions of the operator's cab of a front end loader due to the operator not using the seat belt provided in the vehicle, on or about 12/10/90. Among other methods, one feasible and acceptable method to correct this hazard is to establish and enforce a strict company policy requiring employees to use seat belts while operating any vehicle equipped with a protective structure (ROPS) or adequate canopy protection.
